Withdrawal notice
This notice applies to the purchase of Pro access to BrightComb Compound Simulator from BrightComb (sole proprietorship), owner Gor Davidovic Gevorkjan, by consumers. Pro access is digital content that is not supplied on a tangible medium. The German version of this notice is authoritative; this English version is a translation for information.
Important first: You can only buy after expressly agreeing that we start performance immediately and acknowledging that you thereby lose your right of withdrawal. Pro access is activated automatically right after payment. The right of withdrawal therefore expires upon activation (§ 356 (5) German Civil Code, see below). We are nevertheless required to provide the full statutory notice below.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (BrightComb, Gor Davidovic Gevorkjan, Teichmummelring 65, 12527 Berlin, Germany, E-Mail hello@wildcomb.app) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
You can also exercise your right of withdrawal online at brightcomb.com/legal/withdraw (button “Withdraw from contract” at the bottom of every page). If you use this online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without undue delay, containing the content of the withdrawal declaration and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Early expiry of the right of withdrawal
In the case of a contract for the supply of digital content which is not supplied on a tangible medium, the right of withdrawal expires if we have begun performance of the contract after you have expressly consented to us beginning performance of the contract before the end of the withdrawal period, you have acknowledged that you thereby lose your right of withdrawal once performance of the contract begins, and we have provided you with a confirmation of the contract on a durable medium (§ 356 (5) German Civil Code, BGB).
You give this consent and acknowledgement via the checkbox immediately before payment. We log it with a timestamp and activate Pro access immediately after confirmation of payment. From that moment withdrawal is excluded. Your statutory warranty rights for digital products (§§ 327 et seq. BGB) remain unaffected; in case of technical problems or defects please write to us at hello@wildcomb.app.
